These Terms of Service ("Terms") are a binding agreement between you ("User", "you") and Fautor LLC, a limited liability company organized under the laws of the State of Wyoming ("Fautor", "we", "us"). By registering for or using Fautor Legal AI ("the Software"), you agree to these Terms. If you do not agree, do not use the Software.
Subject to your compliance with these Terms and timely payment of applicable fees, Fautor LLC grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on the single Mac computer registered to your account. The license is tied to that computer's MAC address. You may not copy, distribute, sublicense, reverse-engineer, or modify the Software.
The Software, including all underlying code, algorithms, machine learning models, designs, and documentation, is and remains the sole property of Fautor LLC. Nothing in these Terms transfers any ownership interest in the Software to you. All rights not expressly granted are reserved.
New accounts receive a 7-day free trial. No credit card is required. At the end of the trial period, access to the Software will be suspended until a paid subscription is activated. Fautor reserves the right to modify or discontinue the free trial offering at any time.
The Software is intended for use by licensed immigration attorneys, paralegals, and their authorized staff in the United States. You agree not to use the Software for any unlawful purpose, to process data of individuals without their consent, or in violation of applicable U.S. federal or state law including U.S. immigration law.
All client case data processed by the Software is stored exclusively on your local computer. Fautor LLC does not have access to, and does not collect, any client immigration records, personally identifiable information of your clients, or documents processed through the Software. You are solely responsible for the security of your local data.
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. FAUTOR LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FAUTOR LLC DOES NOT WARRANT THAT AUTOFILLED USCIS FORMS ARE FREE OF ERRORS OR THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS. YOU ARE SOLELY RESPONSIBLE FOR REVIEWING ALL FORMS BEFORE FILING WITH ANY GOVERNMENT AGENCY.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FAUTOR LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SOFTWARE, EVEN IF FAUTOR LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FAUTOR LLC'S TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO FAUTOR LLC IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Fautor LLC and its members, officers, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Software, your violation of these Terms, or your violation of any applicable law.
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law principles. Any dispute arising from these Terms shall be resolved by binding arbitration in Cheyenne, Wyoming under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to participate in a class-action lawsuit or class-wide arbitration.
Fautor LLC may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Your continued use of the Software after the effective date constitutes acceptance of the updated Terms.
Fautor LLC may suspend or terminate your access to the Software immediately for breach of these Terms, non-payment, or misuse. Upon termination, your license to use the Software ends. Your locally stored data remains yours and is unaffected.
